Welcome to Avgeek! These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and Praveen Thirumurugan ("we," "us," "our," or "Company") governing your access to and use of the Avgeek web application, mobile applications, and related services (collectively, the "App" or "Services").

BY USING Avgeek, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE, DO NOT USE THE APP.

1. Acceptance of Terms

By downloading, installing, accessing, or using Avgeek, you:

Agree to be bound by these Terms and our Privacy Policy
Represent that you have the legal capacity to enter into this Agreement
Consent to receive communications from us electronically

If you do not agree to these Terms, you must immediately cease using the App.

2. Eligibility

You must be at least 13 years old to use this App. By using the App, you represent that you meet this age requirement and have the legal capacity to enter into this Agreement.

3. User Accounts

3.1 Account Creation

When creating an account, you agree to:

Provide accurate, current, and complete information
Maintain the security and confidentiality of your account credentials
Not share your account credentials with others
Notify us immediately at mail@praveent.com of any unauthorized access
Accept full responsibility for all activities under your account

3.2 Account Termination

You may terminate your account at any time through the App settings or by contacting us at mail@praveent.com. We reserve the right to suspend or terminate your account for violations of these Terms.

4. The Services

4.1 Flight Tracking

Avgeek provides flight tracking and management services including flight search, real-time status updates, trip organization, statistics, and related features. Flight data is sourced from third-party aviation data providers.

4.2 Data Accuracy

While we strive for accuracy, flight data is provided by third-party sources and may contain inaccuracies, delays, or errors. We do not guarantee the accuracy, completeness, or timeliness of any flight data. Do not rely solely on Avgeek for time-critical travel decisions.

4.3 Service Availability

We aim to provide continuous access to the Services but do not guarantee uninterrupted availability. The App may experience downtime for maintenance, updates, or due to circumstances beyond our control.

5. Subscriptions and Payments

5.1 Free and Pro Tiers

Avgeek offers a free tier with limited features and paid Pro subscriptions with expanded capabilities. Pro subscriptions are available as monthly, yearly, or lifetime plans.

5.2 Pricing and Payment

All fees are in USD unless otherwise stated
Payments are processed through Stripe, Apple App Store, or Google Play Store
Prices are subject to change; existing subscribers will be notified of changes
Taxes may apply based on your jurisdiction

5.3 Subscription Renewal

Monthly and yearly subscriptions automatically renew unless canceled before the renewal date. You may cancel your subscription at any time through the App or your app store account settings.

5.4 Refunds

Refund requests are subject to our Refund Policy and the policies of the applicable payment processor.

6. Acceptable Use

6.1 Permitted Use

The App is provided for your personal use. You may use the App only in compliance with these Terms and all applicable laws.

6.2 Prohibited Conduct

You agree not to:

Attempt to gain unauthorized access to the App, accounts, or systems
Reverse engineer, decompile, or attempt to derive source code
Use automated systems to scrape, data mine, or access the App
Interfere with or disrupt the App or connected networks
Use the App for any illegal or unauthorized purpose
Impersonate any person or entity
Transmit viruses, malware, or other harmful code
Resell, rent, or sublicense access to the App
Reverse engineer or attempt to extract source code
Use automated systems to scrape or data mine
Resell or redistribute the App or its content
Abuse flight data provider integrations

7. Intellectual Property

7.1 Our Ownership

The App and all its content, features, and functionality are owned by Praveen Thirumurugan and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal purposes.

7.2 Your Content

You retain ownership of content you provide (flight notes, journal entries, uploaded files). By uploading content, you grant us a license to use it for providing and improving the Services.

7.3 Feedback

If you provide feedback or suggestions, you grant us a perpetual, royalty-free license to use such feedback for any purpose.

8. Third-Party Services

The App integrates with third-party services including aviation data providers, weather services, payment processors, and authentication providers. Your use of these integrations is subject to their respective terms and privacy policies. We are not responsible for the practices or content of third-party services.

9. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that:

The App will be uninterrupted, secure, or error-free
Flight data will be accurate, complete, or timely
Results obtained from the App will meet your expectations
Automated check-in will always succeed

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Praveen Thirumurugan SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING LOSS OF DATA, MISSED FLIGHTS, INCORRECT FLIGHT INFORMATION, OR FAILED CHECK-INS.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR $100.

11. Indemnification

You agree to indemnify and hold harmless Praveen Thirumurugan from any claims, liabilities, damages, losses, and expenses arising from your use of the App, violation of these Terms, or infringement of any rights.

12. Governing Law and Disputes

These Terms are governed by the laws of State of Delaware. Any disputes will be resolved through binding arbitration administered by the American Arbitration Association, unless you opt out within 30 days by writing to mail@praveent.com.

CLASS ACTION WAIVER: YOU AGREE TO RESOLVE DISPUTES ONLY ON AN INDIVIDUAL BASIS.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or in-app notification. Continued use after changes constitutes acceptance.

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
